Implanting an Electronic Health Record Chip into Every US...

Background Scenario The technology has been developed for a medical chip that individuals wear that contains all their health information. This information would constantly be up to date, and essentially provide real time information in any emergency situation, travel, or if the patient could not speak or give coherent answers. We are taking part in a seminar to discuss the pros and cons of implanting an electronic health record (EHR) into every US citizen ostensibly at birth or prior to school age, and then wearing it until demise. Research - Preparing for the seminar, a number of interesting opinions and materials are discovered. Legal The idea of a person wearing an HER has a number of legal implications. If the patient had complete control over who viewed the material (as they would if they hand carried their information, then the subject of privacy might change. However, if the patient was in an accident and unable to give consent for the sharing of information, they would either need to do this beforehand and in general, or the medical facility would require a way to authorize data in a life or death situation. There are also several legal ideas one must ask about first: is the chip read only (as in only taking info); or read-write (giving and taking info); or, would the chip have a tracking device built in? In common law, much like with assisted suicide, etc. the issue becomes one of individual rights to privacy versus the utility of the implant.
